Hostnin Terms & Conditions

Introduction
- These Terms and Conditions ("Terms") govern the use of services offered by Hostnin ("we," "us," "our") to customers ("you," "your").
- By signing up, purchasing, or using our services, you agree to be bound by these Terms.
- These Terms are designed in compliance with Bangladeshi law, and international best practices where applicable.
- If you do not agree with these Terms, you must immediately stop using our services.
Governing Law & Jurisdiction
- These Terms shall be governed by the laws of Bangladesh.
- Any dispute shall be subject to the exclusive jurisdiction of the courts of Bangladesh (primarily Dhaka or Chattogram).
- Hostnin reserves the right to cooperate with legal authorities in case of misuse or criminal activity.
Account Registration & Responsibilities
- You must provide accurate and complete information during account creation.
- You are responsible for keeping login credentials secure. Hostnin is not liable for loss due to compromised passwords.
- Accounts registered with fake names, fake addresses, or fraudulent contact information may be terminated without notice.
- One person or business may not create multiple accounts to exploit promotions, discounts, or abuse policies.
Acceptable Use Policy (AUP)
4.1 Prohibited Content
- Adult content, pornography, escort services, or sexually explicit material.
- Child exploitation or abuse material.
- Illegal gambling, betting, or lottery websites (without government approval).
- Political propaganda against the state, terrorism, or anti-religious content.
- Piracy, warez, nulled/cracked software distribution.
- Fake bank/MFS login pages, phishing, or fraud.
- Drugs, alcohol, weapons, or arms sales violating Bangladeshi law.
4.2 Prohibited Activities
- Spamming (emails, SMS, WhatsApp).
- Hosting malware, botnets, or backdoors.
- Sending DDoS attacks or using hosting as attack infrastructure.
- Unauthorized cryptocurrency mining.
- Using hosting for "storage-only" purposes (Google Drive alternatives, movie hosting).
4.3 Misuse & Abusive Behavior
- Clients must not harass or abuse Hostnin staff (support tickets, phone, WhatsApp, or social media).
- Abusive language, threats, or defamation against Hostnin or its employees may lead to immediate termination.
Resource Usage & Fair Usage Policy
- Hosting resources (CPU, RAM, bandwidth, inodes, emails) are shared. Excessive usage that disrupts other users will result in limits, suspension, or upgrade requests.
- Unlimited hosting is subject to "fair usage" not for hosting file sharing sites, video streaming libraries, or backup archives.
- Bulk email sending is forbidden unless pre-approved (for businesses with opt-in subscribers only).
Payments, Billing & Refunds
- All prices are listed in Bangladeshi Taka (BDT). For international customers, USD equivalents may apply.
- Payments must be made in advance for all services. Unpaid invoices after due date may result in account suspension.
- Accepted payment methods include bKash, Nagad, Rocket, local bank transfer, card payments, PayPal, Stripe.
- Refunds:
- - Hosting plans: 30-day money-back guarantee (conditions apply).
- - Non-refundable: domains, SSLs, VPS, dedicated servers, software licenses, SEO services.
- - Refunds due to customer misuse/abuse will not be provided.
- Chargebacks: Initiating a chargeback without contacting Hostnin first is considered abuse and may lead to permanent account ban.
Suspension & Termination
- Hostnin reserves the right to suspend or terminate services if:
- - Terms are violated.
- - Payment is overdue beyond 7 days.
- - Hosting is used for illegal or harmful purposes.
- - Misuse/abuse impacts other customers or server performance.
- Terminated accounts lose all stored data permanently. Hostnin is not responsible for data recovery after termination.
- Hostnin may blacklist abusive customers across all Hostnin brands permanently.
Data Security & Backups
- Hostnin provides automated backups (daily/weekly, depending on plan), but clients are responsible for their own backups.
- Hostnin is not liable for data loss caused by: hacking, accidental deletion, software corruption, or hardware failure.
- Clients must secure their CMS (WordPress, Joomla, etc.) with strong passwords, updated plugins, and security best practices.
Support & Communication
- Support is provided via ticket, live chat, WhatsApp, and email.
- Support does not include: coding, fixing client-side errors, or third-party software development.
- Clients must maintain respectful communication with support staff.
- Misuse of support channels for spamming, threats, or harassment may lead to suspension.
Domain Registration & Ownership
- Domain registration is subject to ICANN and relevant registry rules.
- Domains are the sole property of the registered owner (the client).
- Hostnin is not responsible for expired domains if renewal invoices are unpaid.
- Users must check the validity after renewal and contact if there any issue. If any API or registry issue happens and users don't contact immediately, Hostnin will not be responsible.
Service Availability (Uptime SLA)
- Hostnin targets 99.9% uptime for shared hosting and 100% uptime for cloud hosting.
- SLA credits (partial refunds) may be provided if uptime falls below 99% in a given month (excluding force majeure, maintenance).
- Planned maintenance will be notified in advance.
Legal Compliance & Government Requests
- Clients must comply with all Bangladeshi laws, including ICT Act, BTRC rules, and financial transaction rules.
- Hostnin will cooperate with government authorities if required for investigation.
- Hosting accounts may be suspended without notice if government/legal orders demand it.
Privacy & Data Handling
- Hostnin follows its Privacy Policy for handling personal data.
- Data may be shared with payment processors, domain registrars, and security providers as necessary.
- Personal data will not be sold to third parties.
Limitation of Liability
- Hostnin is not liable for:
- - Client's illegal use of hosting.
- - Financial losses due to downtime, hacking, or misconfiguration.
- - Content hosted by clients.
- - Third-party software vulnerabilities.
- Maximum liability of Hostnin is limited to the amount paid by the client in the past 6 months.
Indemnification
- You agree to indemnify and hold Hostnin harmless from claims, damages, or expenses arising from your:
- - Content hosted on our servers.
- - Violation of laws or third-party rights.
- - Misuse or abuse of services.
Account Closure by Customer
- Clients may close their account anytime by submitting a cancellation request.
- No partial refunds for unused subscription periods (unless covered by 30-day guarantee).
- Once closed, all files, emails, and backups will be permanently deleted.
Affiliate Program Terms
- Self-Referral & Fraud Prohibited: Affiliates cannot earn commissions on their own purchases or on purchases made by entities they own or control. If detected, commissions will be revoked and the affiliate account may be permanently terminated without notice.
- Active Service Requirement: To request commission withdrawals, the affiliate must have at least one active, paid Hostnin service.
- Commission Maturity Period: Commissions become eligible for withdrawal 30 days after the referred customer’s payment. Pending commissions will appear in the dashboard but cannot be withdrawn until they have matured.
- Minimum Withdrawal Threshold & Batch Processing: Commissions can only be withdrawn in multiples of ৳5,000. Each withdrawal request will process the maximum full batch of ৳5,000 available (Example: If the affiliate balance is ৳5,500, ৳5,000 will be processed and the remaining ৳500 will roll over to the next payout). Withdrawals cannot be requested for amounts below ৳5,000.
- Fraud, Abuse & Chargebacks: Any fraudulent sign-ups, coupon abuse, or referrals that later result in cancellations or chargebacks will void commissions.
- Right to Audit: Hostnin reserves the right to audit affiliate accounts and deny or reverse commissions if abuse or violations are detected.
- Account Termination: Affiliates violating these terms may have their accounts terminated and unpaid balances forfeited.
Domain Registration & Renewal Policy
- Domains are registered according to ICANN rules and relevant registries.
- Hostnin is not responsible for loss of domains due to expired renewals if invoices are unpaid or incorrect contact details are provided.
- Renewal reminders are sent as a courtesy only; it is the customer’s responsibility to renew on time.
- Domains may be suspended or cancelled due to trademark disputes, ICANN compliance actions, or legal orders.
Content Liability & Copyright Policy (DMCA)
- Customers are solely responsible for the content hosted on their websites.
- Hostnin complies with Digital Millennium Copyright Act (DMCA) takedown notices and may suspend services for repeat infringements.
- Hosting of pirated content, copyrighted material without permission, or illegal files is strictly prohibited.
Acceptable Email Usage & Anti-Spam Policy
- Sending unsolicited bulk email (spam), phishing campaigns, or mass marketing without consent is forbidden.
- Violations may lead to immediate suspension without refund.
- Hostnin may block outbound mail ports or throttle mail delivery to maintain network reputation.
Resource Abuse & Server Security
- Customers may not use hosting services for crypto mining, malware distribution, or running scripts that compromise server stability.
- Excessive resource use (CPU, RAM, I/O, bandwidth) that affects other customers may result in throttling, suspension, or upgrade requirement.
- Customers must maintain secure software (e.g., update CMS, plugins) to avoid being hacked.
Backup & Data Restoration Policy
- Hostnin performs backups as a courtesy but does not guarantee data integrity.
- Customers are responsible for maintaining their own backups.
- Hostnin is not liable for data loss due to system failure, account suspension, or termination.
- Data restoration (if available) may incur a fee.
Payment Disputes & Chargebacks
- Filing a chargeback or payment dispute immediately suspends all associated services.
- Accounts involved in chargebacks may lose eligibility for refunds and future services.
- Any fees incurred from chargebacks will be billed to the account owner.
Price Changes & Plan Modifications
- Hostnin reserves the right to adjust pricing, plans, or included features with prior notice.
- Existing customers will be billed at the agreed rate until the end of the current billing cycle.
Third-Party Services & Licenses
- Services may include third-party tools or licenses (e.g., cPanel, LiteSpeed, Imunify360).
- Hostnin is not liable for changes, outages, or price adjustments from these third-party providers.
- Customers must comply with all relevant third-party license terms.
Limitation of Liability (Extended)
- Hostnin shall not be liable for indirect, incidental, special, or consequential damages (loss of profits, revenue, or data).
- Maximum liability in any case is limited to the amount paid for the service during the last billing cycle.
- Hostnin is not responsible for business interruption, loss of reputation, or damages resulting from downtime.
Indemnification (Extended)
- Customers agree to indemnify and hold Hostnin, its employees, and affiliates harmless against any claims, damages, or expenses arising from use of our services, violation of these Terms, or infringement of third-party rights.
Reseller Hosting Terms
- Resellers are responsible for the conduct of their own clients.
- Abuse or violations by reseller clients may result in suspension or termination of the reseller’s account.
- Hostnin does not provide direct support to end-users of reseller clients.
Governing Law & Dispute Resolution (Expanded)
- All disputes shall be resolved under the laws of Bangladesh (or the relevant jurisdiction of the company’s registration).
- In case of disputes, parties agree to attempt mediation before seeking court action.
Service Level Agreement (SLA) Disclaimer
- While Hostnin aims for high uptime, scheduled maintenance or unexpected outages may occur.
- SLA credits (if applicable) are limited to future service credits and cannot be exchanged for cash.
Early Termination & Refund Limitations
- No refunds are issued for early cancellation of services unless covered under the 30-Day Money-Back Guarantee.
- Refunds for prepaid plans may be prorated at Hostnin’s discretion.
Account Ownership & Transfer
- The person/entity listed as the primary contact in the Hostnin account is considered the legal owner.
- Ownership transfer requests must be made in writing with proper verification.
Prohibited Content (Explicit List)
- Child exploitation or abuse material
- Hate speech or incitement to violence
- Malware, phishing pages, or hacking tools
- Fraudulent or misleading business practices
- Content violating intellectual property rights
Severability & Entire Agreement
- If any part of these Terms is held invalid by a court, the remainder will stay enforceable.
- These Terms represent the entire agreement between Hostnin and the customer, superseding any prior agreements.
Changes to Terms
- Hostnin may update these Terms from time to time.
- Updates will be published on our website, and clients will be notified via email for major changes.
- Continued use of services after updates constitutes acceptance.
